1. Who we are

These Terms of Service (“Terms”) govern access to and use of the website, APIs, and tools operated under the FPS.monster brand (the “Service”), operated by the operators of FPS.monster (“we”, “us”, or “our”).

2. Acceptance

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. What the Service is (and is not)

FPS.monster aggregates publicly available product listing information from third-party marketplaces and retailers, then ranks and displays that information using our own scoring, filtering, and estimated performance models (including dollars-per-FPS and related metrics).

• We are not a retailer. We do not sell computers, take payment for hardware, hold inventory, or fulfill orders.
• We are not the seller of record. Purchases happen on third-party sites under those sellers’ terms, privacy policies, and return policies.
• Estimates only. FPS, $/FPS, Monster Ratings, and similar figures are model-based estimates derived from incomplete public data. Real-world performance varies with game settings, drivers, thermals, resolution, and many other factors.
• No warranty of accuracy. Titles, specs, prices, stock status, images, and discounts can be wrong, stale, or incomplete. Always verify on the destination listing before purchasing.

4. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with a parent or guardian’s involvement. The Service is not directed at children under 13.

5. Accounts & admin access

Most of the Service is usable without an account. Administrative areas are restricted to authorized operators. You must not attempt to access admin interfaces, crawl controls, or internal APIs without authorization.

6. Acceptable use

You agree not to:

• Scrape, bulk-download, or systematically extract the Service in a way that degrades availability, bypasses rate limits, or copies our ranking datasets for competing commercial use without written permission;
• Probe, scan, or attack the Service (including denial-of-service, credential stuffing, SSRF attempts against our analyze/crawl tooling, or exploitation of parser execution paths);
• Interfere with overnight crawl jobs, cron endpoints, or shared infrastructure;
• Misrepresent affiliation with FPS.monster, NVIDIA, AMD, Intel, Apple, or any marketplace we index;
• Use the Service to violate law, including export controls, consumer protection rules, or marketplace terms that bind you as a buyer.

We may suspend or block access (including IP-level controls) when we reasonably believe these rules are violated.

7. Third-party links & retailer relationships

Product cards and “buy” actions typically deep-link to third-party storefronts. Those sites are outside our control. Today, outbound links go to retailers directly and are not affiliate-tagged — we do not currently earn commissions from your clicks or purchases. We may add affiliate or referral programs later; if we do, we will update these Terms and disclose that clearly on the Service. Third-party relationships (now or in the future) do not change our ranking methodology’s goal of highlighting value, and they do not make us responsible for the seller’s product, shipping, taxes, or support.

8. Intellectual property

The FPS.monster name, eye mark, site design, software, ranking logic, and original content are owned by us or our licensors. Marketplace product titles, images, and trademarks belong to their respective owners and are shown for identification and informational purposes under applicable fair use / nominative use principles where available.

You may not copy, frame, or mirror the Service for commercial redistribution without prior written consent.

9. Analyze, calculator & experimental tools

Tools such as URL analyze and the FPS calculator are provided “as is.” Analyze may fetch third-party pages through our infrastructure. You must only submit URLs you are allowed to access. Do not submit credentials, private network addresses, or content you do not have rights to process. We may rate-limit, queue, or disable these tools to protect the Service and third parties.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, COMPLETE, CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OPERATORS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY ESTIMATE OR LISTING. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE PRIOR TWELVE MONTHS (IF ANY), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.

12. Indemnity

You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of third-party rights — except to the extent caused by our willful misconduct.

13. Changes to the Service or Terms

We may modify features, rankings, crawl schedules, or these Terms. Material changes will be reflected by updating the “Last updated” date on this page. Continued use after changes constitutes acceptance. If you disagree, stop using the Service.

14. Suspension & termination

We may suspend or terminate access immediately for abuse, security risk, legal compliance, or operational necessity (including protecting overnight crawl capacity on shared hosting). Provisions that by nature should survive (disclaimers, liability limits, indemnity, IP) survive termination.

15. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise. Courts in that venue will have exclusive jurisdiction, subject to those mandatory rights.
